1. Scope and contracting party

These General Terms and Conditions (GTC) apply to all orders placed through our online shop.

The contracting party is:

These terms and conditions apply to the entire offering of the "galeriefarbspiel.de" website, including the online sale of "Fine Art Prints".

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the "Order with obligation to pay" button (or a comparable, clearly labeled button in your shopping cart), you submit a binding offer for the goods contained in the shopping cart.

The purchase contract is concluded only with our explicit order confirmation by e-mail.

3. Prices and shipping costs

3.1 The prices stated on the product pages are final prices. They do not include sales tax, as the seller is a small business owner in accordance with § 19 UStG.

3.2 In addition to the stated prices, we charge shipping costs for delivery within Germany.

3.3 Shipping costs are a flat rate of 9.95 EUR per order.

3.4 For orders over 299.00 EUR, I deliver free of charge.

3.5 The shipping costs will be clearly communicated to you again in the shopping cart system and on the order page.

4. Delivery and delivery times

4.1 The goods will be delivered by shipping to the delivery address specified by the customer.

4.2 Since our products are Fine Art Prints custom-made for you (Print on Demand), the delivery period begins upon receipt of full payment. Production time and subsequent shipping typically take approx. 10 to 14 business days. Should there be differing delivery times in individual cases, we will inform you immediately after the conclusion of the contract.

4.3 Should an ordered item unexpectedly not be available, we will inform you immediately and refund any payments already made without delay.

5. Payment terms

5.1 Payment can be made via PayPal, credit card, Klarna or via other payment methods offered during the ordering process. We reserve the right to exclude certain payment methods in individual cases.

5.2 The purchase price is due immediately upon conclusion of the contract. The production of the goods by our partner will only be initiated after full payment has been received.

6. Retention of title

6.1 The goods remain our property until full payment of the purchase price.

6.2 Before the transfer of ownership, pledging, collateral assignment, processing or modification is not permitted without our express consent.

7. Right of withdrawal and exclusion of the right of withdrawal

7.1 Consumers generally have a right of withdrawal.

7.2 Since our offer consists of Fine Art Prints custom-made for you, which are produced exclusively for you only after receipt of your order, the right of withdrawal is excluded for these products according to § 312g para. 2 no. 1 BGB.

7.3 By completing the order, you expressly agree to this exclusion of the right of withdrawal for individually manufactured goods.

7.4 The exclusion of the right of withdrawal naturally does not affect your statutory warranty rights (see point 8).

8. Warranty and liability for defects

8.1 The statutory warranty rights apply.

8.2 Should the goods show transport damage or production defects upon receipt, we ask the customer to inform us immediately, stating the order number and attaching meaningful photo material.

8.3 We will examine the matter and, in the case of justified defects, arrange for a replacement delivery in consultation with you or refund the purchase price.

9. Copyright

All products of the artist are protected by copyright. By acquiring a product, the customer does not acquire ownership of the copyrights or usage rights. In particular, rights to reproduction, digital use, public display or further use in other media or products are expressly excluded. Any further use requires the written consent of the artist.

10. Applicable law and place of jurisdiction

9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 If the customer is a merchant, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the registered office of our company.

11. Storage of contract text

The contract text is stored by us and is accessible to the customer after sending their order, together with these GTC, in text form (e.g. by e-mail).

12. Severability clause

Should individual provisions of these GTC be or become wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected.
